1. Entering the Contest and Choosing and Contacting the Winner
Entries will be judged entirely at the discretion of St. Clair Software. The winning entry will be the single submission judged most likely to succeed as a commercial software program for Apple's iPod Touch and iPhone. Criteria will include, but not be limited to, aesthetic appeal, uniqueness, marketability, and feasibility of implementation.
Entrants must send entries using the correct contest form or email address. St. Clair Software is not responsible for and will not consider incomplete or incorrect entries, or emails or submissions sent but not received by St. Clair Software for any reason, as potential contest winners.
Multiple entries are permitted, but each entry must be fully specified in a single submission. Supplementary material such as drawings, mock-ups, and references may be included as URLs.
Entries must be received before 12:00 AM EDT, April 1, 2008.
The winner of the contest will be contacted at the email address used to enter the contest, and the person receiving and replying to the winner announcement email will be considered the winner unless they specify another person within the reply email as the winner. St. Clair Software will mail the contest prize to the address supplied by the recipient of the winner announcement email.
Claiming of the prize requires an email response to St. Clair Software from the winning sender email address within 30 days of being notified of winning at the email address used to enter. Failure to respond shall mean that the winner forfeits the prize.
2. Submission of concepts, drawings, photos, text or other information for the Contest
By submitting any concepts, drawings, photos, text or information to St. Clair Software, you hereby grant to St. Clair Software and its affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted information in any and all forms, whether now known or hereinafter created, throughout the world and for any purpose;
By submitting any concept, photo, drawing or information to St. Clair Software, you hereby represent and warrant that the submitted concept, photo, drawing or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to St. Clair Software herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances;
You acknowledge and agree that St. Clair Software shall have no obligation to post, display or otherwise make publicly available any concept, photo, drawing or information submitted by you;
You understand and intend that any concept, photo, drawing or information submitted by you to St. Clair Software may be available for viewing and comment on by the public, and understand that comments with which you disagree or are unhappy about may be published or otherwise become associated with any information you submit to St. Clair Software. By submitting any concept, photo, drawing or information to St. Clair Software, you hereby waive any privacy expectations that you may have with respect to any such information submitted by you to St. Clair Software.
You hereby agree to hold St. Clair Software and its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any St. Clair Software site or in any St. Clair Software product, or any other use authorized under these Terms, of any information submitted to St. Clair Software by you;
Concepts, photos, drawings or information submitted by you to St. Clair Software shall be the intellectual and real property of St. Clair Software, and St. Clair Software shall have no obligation to preserve, return or otherwise make available to you or others any information so submitted.
3. Awarding of the Prize
The winner will receive a 16 GB iPod Touch (approximate retail value $399). No cash or prize substitution, transfer or assignment by winner is allowed. St. Clair Software reserves the right to substitute a prize of equal or greater value if the prize or a portion of it becomes unavailable. Applicable taxes and any other expenses not specified here are the winner’s sole responsibility. The only prize being awarded is one iPod Touch. No additional or other prizes are being awarded.
The prize winner must supply St. Clair Software with his/her legal name, mailing address, birth date, daytime and nighttime telephone numbers.
Neither St. Clair Software, St. Clair Software sponsors, nor employees of St. Clair Software or sponsors may be held liable for any warranty, costs, damage, injury, or any other claims incurred as a result of usage of any winners of a prize once possession has been taken of the product by winner. St. Clair Software is not liable for any loss arising out of or in connection with or resulting from any contest promoted by St. Clair Software.
Management, employees and families of St. Clair Software are prohibited from winning any prizes awarded by St. Clair Software
